"CONSUMER PROTECTION AGAINST UNCLEAR INFORMATION ON THE PRACTICE OF SELLING RUQYAH SALT ON THE TOKOPEDIA MARKETPLACE PLATFORM ACCORDING TO ISLAMIC AND POSITIVE INDONESIAN LAW
The proliferation of ruqyah salt products sold online on marketplace platforms, particularly Tokopedia, reflects how the public's belief in ruqyah media, such as salt, can be commercialized by businesses. This is because businesses clearly promote these ruqyah salts in their sales practices by leveraging narratives of a religious or spiritual nature—such as protecting oneself from the interference of jinn and magic, facilitating prosperity and marriage, and so on—which cannot be empirically or scientifically proven, and therapeutic claims that lack clear standards of proof and measurable quality parameters.
The purpose of this study is to answer how consumer protection against unclear information on the practice of selling ruqyah salt is implemented on the Tokopedia marketplace platform, based on the perspective of Islamic and positive Indonesian law, and the form of consumer protection carried out by Tokopedia against against unclear information on the practice of selling ruqyah salt.
The research method used in this study is juridical-empirical research, with the approach used being a case approach and a legislative approach. The case approach was carried out on ruqyah salt sold on the Tokopedia marketplace platform. Meanwhile, the legislative approach is used to assess whether the product has met the consumer protection aspects based on Islamic and positive Indonesian law.
The research results indicate that the three ruqyah salt products do not fully meet or guarantee consumer protection, either under Islamic law or Indonesian positive law. Tokopedia, as the organizer of online buying and selling activities between sellers and buyers, has established policies regarding the terms and conditions of products that can be sold on the Tokopedia marketplace platform. Although Tokopedia has regulated policies regarding product terms and conditions, as well as actions that Tokopedia can take against sellers who violate these policies as a preventive measure, the implementation, enforcement, or supervision of these policies as a repressive measure has not been carried out properly by Tokopedia.
