AL-AQSA MOSQUE UNDER ISRAELI OCCUPATION
(COMPARATIVE FATWAS ON MUSLIMS' VISITS AND THE ISSUE OF NORMALIZATION
This research focuses on examining the fatwas issued by scholars who permit and those who prohibit Muslim visits to Al-Aqsa Mosque, which is currently under Israeli occupation. Studying employs a qualitative approach. The data collection method used in this research is document analysis, namely the systematic search for information related to the relevant issues or variables through classical fiqh texts, related studies, and scholars’ fatwas.
The data analysis applied is a comparative method, which juxtaposes two differing opinions to identify their similarities and differences. Accordingly, this study compares the views of scholars who permit visiting Al-Aqsa Mosque with those who prohibit such visits.
The findings indicate that the divergence of scholarly opinions centers on two main considerations: the potential benefit conferred upon Israel and the possibility of legitimizing or normalizing the occupation. Scholars who prohibit visitation maintain that as long as these two elements remain, the ruling of prohibition stands. Conversely, scholars who permit visitation argue that such visits do not constitute recognition or legitimization of Israel. They also contend that visiting the mosque yields greater benefits (maslahah) for the Muslim community. However, they stipulate that the journey should be made through Jordan to minimize potential advantages for Israel.
