Perception Of Lectures And Students Of The Faculty Of Sharia And Law At UIN Syarif Hidayatullah Jakarta Regarding The Granting Of Remmission
This research is motivated by a public debate over the policy of granting remission to perpetrators of corruption, which is considered contrary to the principles of justice, the effectiveness of punishment, Islamic criminal law, and public trust in the legal system.
The research method used was a descriptive-comparative quantitative approach, with data collected through questionnaires. The research instrument was prepared using a Likert scale and underwent validity and reliability tests, and it includes both closed- and open-ended questions. The research respondents were lecturers and students from the Faculty of Sharia and Law at UIN Syarif Hidayatullah Jakarta. Data were analyzed using descriptive statistics and statistical tests in SPSS, including reliability and perception difference tests.
The study's results show that lecturers and students tend to perceive the policy of granting remission to corruption prisoners as relatively consistent with the policy. However, the two groups of respondents did not completely reject remission absolutely. Still, they showed a critical and selective attitude, especially when the granting of remission was considered to fail to meet the principles of justice, to weaken the effectiveness of punishment and deterrence, to be contrary to the principles of Islamic criminal law, and to reduce public trust. These findings show that remissions for prisoners convicted of corruption should be granted more strictly, transparently, and with due consideration for legal and social factors. This research is expected to make an academic contribution to the study of criminal law and Islamic criminal law, and to inform policymakers in formulating regulations on the provision of remission to prisoners convicted of corruption.
