This study aims to analyze the effectiveness of the implementation of Article 32(2) of Law No.
38 of 2009 on Postal Services regarding the prohibition of shipping hazardous goods via courier
services, using JNE in Depok as a case study. This study employs a qualitative research method,
utilizing data collection techniques through interviews with representatives from JNE in Depok, the
Depok City Police Department, the National Narcotics Agency (BNN), and consumers of courier
services.
The results indicate that JNE Depok City is generally aware of and understands the provisions
of Article 32 paragraph (2) of the Postal Law, as reflected in the company's internal SOPs, employee
training, and police outreach. However, implementation has not been fully optimized due to limited
supporting facilities, resulting in manual package inspections. From a law enforcement perspective,
the police and BNN have taken action and taken preventative measures, but supervision remains
reactive and relies on reports. Meanwhile, consumers generally learn about the prohibition on sending
dangerous goods through information from JNE, although they do not directly understand the legal
basis for it in the Postal Law.
Viewed from the perspective of maslahah mursalah, efforts to prevent the delivery of dangerous
goods through expedition services are actions that are in line with the objectives of sharia, especially
in maintaining the safety of lives (hifz al-nafs) and property (hifz al-mal). Various cases that have
occurred in society, such as the delivery of narcotics and the incident of a truck carrying packages
catching fire due to dangerous goods, show that this prevention policy is urgent and necessary to avoid
greater harm. Thus, the implementation of Article 32 paragraph (2) of the Postal Law can be
considered to have fulfilled the elements of maslahah and does not conflict with the principles of
Islamic law.
