Money politics is a big problem in the implementation of democratic practices,
because it causes many problems in elections and violates the law in Indonesia, has the
potential to damage the principles of justice and honesty and has an impact on the decline
of the quality of leaders, this practice is not only a problem for the legal order in Indonesia,
but also a serious problem that demands great attention from the perspective of Islamic law
and positive law. This study aims to analyze the law of money politics according to the
views of the Indonesian Ulema Council (MUI), Bahtsul Masail (NU), the Muhammadiyah
Tarjih Council and the analysis of Law No. 7 of 2017.
This research method uses a qualitative method through library research. Primary
data sources include the MUI Fatwa, the decision of the results of NU's bahtsul masail, the
Muhammadiyah Tarjih Council and positive law, namely Law No. 7 of 2017, the results of
this study show that all fatwa institutions and positive laws prohibit money politics, the
difference is that MUI and the Muhammadiyah Tarjih Council expressly prohibit the
practice of money politics without any exceptions, while NU still sees the practice of
money politics for the reason, and positive law considers money politics a violation of the
law and has been regulated by sanctions in the Law.
The implications of the results of this study emphasize the importance for the public
to know what money politics is and its laws from an Islamic perspective and positive law
so that it can minimize the practice of money politics, it is necessary to enforce strict laws
for money politics actors.
