REVIEW OF ISLAMIC LAW’S AGAINTS LATE CHARGE INSHOPEEPAYLATER BILLS ON ONLINE

This study aims to explain how the Islamic Fiqh views on the practice of buying and selling using Shopeepaylater payments and to explain how the law of late payment of bills, provides education to people who are in need of legal certainty about how late fines on Shopee paylater. This transaction was born because of the impact of the times where this activity is a new problem for all of us.
Shopee requires a lag penalty of 5% of the total bill to its users who are late paying bills, the author refers to the fatwa DSN MUI No. 54 / DSN-MUI / X / 2006 which contains the ability to apply latecharge (late penalty) on Sharia credit cards.
This research uses a type of normative juridical research and library research with an assessment of MUI fatwas, books, scientific journals and jurisprudence books related to the title of this thesis.
The results of the author's research that this transaction model can be called buying and selling istijrar, where scholars agree the law may be if there is a market price (syi'rulmitsli), but about how the law against late fines is prohibited or haram, because according to Islamic fiqh requires a fine on the qardh contract included in the ribawi transaction which will actually provide benefits to muqridh, although the purpose of the fine is noble, to give a reprimand against muqtaridh who is not in good faith to fulfill his obligation to pay debts, in the rule of jurisprudence states that any loan that provides benefits is riba, in the Qur'an it is very clearly said that Allah hates activities that contain elements of usury.
