MAQASHID AL-SYARI'AH REVIEW ON THE USE OF MASKS FOR PEOPLE WHO ARE IN IHRAM BASED ON MUI FATWA NUMBER 3 OF 2020
This research is in the form of research (Library Research) using library sources as research data sources, with the aim of exploring maqashid al-syari'ah alam MUI Fatwa Number 3 of 2020 in an effort to prevent transmission of Covid-19 for people who are in ihram during the pilgrimage . This study applies a descriptive-normative approach because it is aimed at the existence of maqashid al-shari'ah in the Fatwa regarding the permissibility of wearing masks for people who are in ihram as a real phenomenon and as a social response to society, and departs from primary and secondary data sources as support.
Results research is the first that in MUI Fatwa No.3 of 2020, wearing a mask for people who are in ihram is permissible as long as it is in an emergency/urgent condition such as the threat of transmission of dangerous diseases, extreme weather and health conditions. And if it is not in an emergency/urgent condition, someone who is in ihram for Hajj or Umrah is not allowed to wear a mask. Wearing a mask for people who are in ihram can be said to be haram when it is not an emergency/urgent. And the results of the second study, the permissibility of wearing a mask during ihram in MUI Fatwa No.3 of 2020 includes maqashid Asy-Syari'ah at the level of dharuriyah needs because if these needs are not guaranteed, then there will be chaos and imbalance
