Legal Protection Of Online Drivers On Partnership Rights With Pt. Grab Teknologi Indonesia
This research aims to determine legal protection for drivers online whose partnership rights were violated by PT. Grab Teknologi Indonesia from the perspective of positive law and Islamic law.
The type of research used in this thesis is qualitative research which is descriptive analysis. This research was conducted by interviewing 3 sources who were drivers online at PT. Grab Technology Indonesia. The data sources used in this research are primary data sources obtained from interviews and secondary data sources obtained from library literature.
Based on the results of the research in this thesis, there was a violation of partnership rights committed by PT. Grab Teknologi Indonesia to drivers online, This can be seen in the partnership agreement between them which is very detrimental to drivers online. One of them is the contents of the contract agreement made unilaterally by Grab and the driver online only have the option to agree to it. Regulations governing legal protection related to partnership rights are regulated in Article 35 of Law No. 20 of 2008 concerning micro, small and medium enterprises. In this article it is stated that large businesses (PT. Grab Teknologi Indonesia) are prohibited from owning or controlling micro, small and medium businesses (drivers online) as its business partner. As for the service standards and healthy competition that must be carried out by all application parties, it is regulated in articles 198 and 199 of Law Number 22 of 2009 concerning road traffic and transportation relating to the regulations of the Minister of Transportation of the Republic of Indonesia Number KP 667 of 2022 and Number KP 1001 2022. According to Islamic law, the contract used in partnership practice between PT. Grab Teknologi Indonesia and driver online is a contract Shirkah Inan. There are rules and conditions from Shirkah Inan that must be fulfilled by each party involved in the partnership, there are three things that parties involved in the partnership must not do, namely; At-ta'addi, At-taqshir, and Mukhalafat asy-syuruth.
