Buzzers In Political Issues From The Perspective Of Islamic Law And Law Number 19 Of 2016 On Electronic Information And Transaction

This research was made to find out the regulation of political buzzers who
commit hate speech, defamation, vile slander, and things that aim negatively
on social media in the perspective of Islamic law and Law Number 19 of 2016
concerning Information and Electronic Transactions. As well as strategies
carried out by buzzers when dealing with political issues on social media.
This research uses a qualitative method with a type of empirical juridical
approach and analytical descriptive. The author refers to several sources such
as laws and regulations, journals, articles, internet sites and face-to-face
interviews with sources. Then the results of the research are reviewed
according to the perspective of Comparative Fiqh as the author's analysis knife.
The results of this study indicate that the strategy carried out by buzzers is a
strategy that is very easy to do in the 4.0 era, and it is unlikely that buzzers
will be destroyed on social media which can be said to be like the supernatural
of this buzzer. Because the lack of strong legal rules governing buzzers is one
of the factors that makes the role of political buzzers on social media will
never be eliminated. In Islamic Law, the actions of political buzzers who
commit acts of slander, defamation, spreading false news and so on are crimes
and will be subject to jarimah takzir sanctions, which sanctions will be given
in accordance with the judge's decision, and in the ITE Law buzzers who
commit these negative actions can be subject to Article 27 paragraph (1) and
paragraph (3), Article 28 paragraph (2) by being subject to sanctions contained
in Article 45 paragraph (1), Article 45A paragraph (1) and paragraph (2) of
Law No. 19/2016 on Electronic Information and Transactions. 19 of 2016
concerning Electronic Information and Transactions, then further strengthened
by the Criminal Code Articles 310 to 321.
